Resumen
El Expediente, materia de estudio, versa sobre el litigio laboral encarnado en el obrero José Ángel Nizama Navarro, quien demanda a la empresa Corporación Lindley S.A. (en adelante Lindley S.A.), por desnaturalización de contratos y otros. Alega el trabajador haber estado sometido a un contrato laboral temporal que no le corresponde por realizar labores propias de la actividad principal de la empresa y se le despidió por su afiliación sindical. La Empresa defiende la legitimidad de los contratos modales, amparados por el artículo 82 de la Ley de Productividad y Competitividad Laboral (LPCL), basados en una necesidad temporal por transición tecnológica, proceso que aún no ha terminado y por ello, la empresa sigue requiriendo personal adicional para cubrir necesidades transitorias hasta que culmine la automatización. A lo largo del proceso, las decisiones judiciales han sido contradictorias, el cual culmina en un fallo de la Corte Suprema, expedida en Casación, a favor de la empresa. El informe examina las implicancias legales del caso, evalúa si existió un uso indebido de contratos temporales y si se vulneraron derechos laborales fundamentales.
He case under review concerns a labor dispute. The worker, José Ángel Nizama Navarro, filed a lawsuit against the company Corporación Lindley S.A. (hereinafter "Lindley S.A.") with the main claims of declaring the fixed-term employment contracts invalid and nullifying his dismissal. As an accessory claim to the latter, he requests reinstatement to his previous position; alternatively, he seeks compensation for unfair dismissal. The worker argues that he was subject to a temporary employment contract not applicable to his role since he performed tasks intrinsic to the company's core business and was dismissed due to his union affiliation. The company defends the validity of the fixed-term contracts under Article 82 of the Peruvian Labor Productivity and Competitiveness Law (LPCL), asserting a temporary need driven by ongoing technological transition, which still requires additional staff to address transitional demands until the automation process is complete. Throughout the proceedings, judicial decisions have been inconsistent, culminating in a Supreme Court ruling in favor of the company. This report examines the legal implications of the case, evaluates whether fixed-term contracts were misused, and considers whether fundamental labor rights were violated.
