Resumen
El 11 de mayo de 2016, se interpone una demanda de desalojo por ocupación precaria por parte de ocho demandantes con el fin de que la parte demandada desocupe el predio ubicado en la Calle Pisco N° 117, Cercado de Ica, provincia y departamento de Ica. El juzgado admitió a trámite la demanda en la vía del proceso sumarísimo mediante Resolución N° 01 de fecha 13 de mayo de 2016. Por lo tanto, se dio vista al acto hacia el demandado el 18 de mayo de 2016, quien contestó la demanda dentro del plazo de ley, conforme a su derecho de defensa y principio de contradicción, por lo que el juzgado ordenó señalar fecha y hora para audiencia única para el 20 de junio de 2016. En la audiencia única se declaró la existencia de una relación jurídico procesal válida, fijando el determinar los siguientes puntos controvertidos: si el demandante es propietario del inmueble en cuestión, si el demandado carece de título que pueda amparar la posesión y si corresponde declarar infundada o improcedente la demanda. Por lo que, el juzgado resolvió declarar improcedente los medios probatorios presentados. No obstante, dicha decisión fue materia de recurso de apelación por el demandado, el cual fue concedido sin efecto suspensivo y con la calidad de diferida, mediante Resolución N° 06 de fecha 24 de junio de 2016. Posteriormente, el 21 de octubre de 2016, el Primer Juzgado Civil de Ica emitió sentencia mediante la Resolución N° 10, declarando fundada la demanda, ordenándose que la parte demandada desocupe el bien inmueble. Sin embargo, el 31 de octubre de 2016, se interpuso un medio impugnatorio de apelación por el demandado, el cual fue concedido con efecto suspensivo, mediante Resolución N° 11, de fecha 02 de noviembre de 2016. Por consiguiente, la Primera Sala Civil de la Corte Superior de Justicia de Ica revocó la sentencia apelada (resolución número diez) y reformándola, declaró improcedente la demanda. Ante ello, la parte actora interpuso recurso de casación, donde la Corte Suprema de Justicia de la República declaró fundado el recurso. Finalmente, casó la sentencia y confirmó la sentencia apelada (resolución número diez) que declaró fundada la demanda, ordenando de tal manera que el demandado desocupe el bien inmueble, materia de litis.
On May 11, 2016, eight plaintiffs filed an eviction lawsuit based on precarious occupancy, seeking to have the defendant vacate the property located at Calle Pisco No. 117, Cercado de Ica, in the province and department of Ica. The court admitted the claim for processing under the summary proceeding track via Resolution No. 01, dated May 13, 2016. Consequently, notice was served to the defendant on May 18, 2016; the defendant answered the complaint within the statutory timeframe—exercising the right to a defense and the principle of adversarial proceedings—whereupon the court scheduled a single hearing for June 20, 2016. At the single hearing, the court affirmed the existence of a valid procedural legal relationship and established the following points of contention: whether the plaintiff is the owner of the property in question, whether the defendant lacks a title justifying possession, and whether the claim should be declared unfounded or inadmissible. The court subsequently ruled the submitted evidence inadmissible. However, the defendant appealed this decision; the appeal was granted without suspensive effect and on a deferred basis via Resolution No. 06, dated June 24, 2016. Subsequently, on October 21, 2016, the First Civil Court of Ica issued a judgment via Resolution No. 10, ruling in favor of the plaintiffs and ordering the defendant to vacate the property. However, on October 31, 2016, the defendant filed an appeal, which was granted with suspensive effect via Resolution No. 11, dated November 2, 2016. Consequently, the First Civil Chamber of the Superior Court of Justice of Ica reversed the appealed judgment (Resolution No. 10) and, modifying it, declared the claim inadmissible. In response, the plaintiff filed an appeal in cassation, and the Supreme Court of Justice of the Republic ruled in favor of the appeal. Ultimately, the Court set aside the appellate ruling and upheld the original judgment (Resolution No. 10)—which had granted the claim, thereby ordering the defendant to vacate the property subject to the dispute.
