Propiedad vs crédito y su concordancia con el sistema registral peruano de propiedad inmueble a la luz del VII Pleno Casatorio Civil

Resumen
La presente investigación se desarrolla sobre la decisión emitida en el VII Pleno Casatorio Civil, de fecha 05 de noviembre de 2015, decisión fundamentada y adoptada por la Corte Suprema de la República en Pleno. Al respecto, se emitieron una serie de precedentes vinculantes que consideran zanjar la discusión entre si prevalece el derecho de propiedad no inscrito o el embargo inscrito en los casos de tercería de propiedad. La intención del trabajo es la de desarrollar una aproximación a los derechos reales y obligacionales, contrastándolos con lo decidido por el Pleno, de manera que permita advertir si el fallo de la Corte Suprema se condice lógicamente con el sistema jurídico peruano de propiedad inmueble, la transferencia de propiedad, la función de los registros públicos y el tráfico de bienes en el mercado contemporáneo.
The present research focuses on the decision issued in the VII Civil Case Law Plenary session, dated November 5, 2015, a decision that was reasoned and adopted by the Supreme Court of the Republic in full session. In this regard, a series of binding precedents were issued, aiming to settle the debate on whether an unregistered property right or a registered levy prevails in cases of third-party claims of ownership. The objective of this work is to develop an approach to real and contractual rights, contrasting them with what was decided by the plenary, in order to determine whether the ruling of the Supreme Court logically aligns with the peruvian legal system regarding real estate property, property transfer, the function of public registries, and the circulation of goods in the contemporary market.
