dc.description.abstractLa presente tesis tiene como finalidad realizar un análisis sobre la vinculación entre daño moral y daño a la persona con el propósito de evaluar la viabilidad de una coexistencia armoniosa. Para ello, se revisará tanto doctrina como jurisprudencia. Históricamente, el daño moral tiene asidero en el ordenamiento jurídico peruano dado el estrecho vínculo entre este último y la vertiente de Francia en que se establece un concepto amplio del daño moral, claro está, también existe un sentido estricto. Por otro lado, la importación del daño a la persona, entendido desde la óptica de la filosofía existencialista y el personalismo jurídico, vino desde Italia, donde el concepto se gestó durante un contexto de posguerra en que se reevaluaba el lugar del ser humano no solo en el Derecho, sino en el mundo. Son dos las categorías a que refieren la división del daño a la persona: por el ente afectado y por las consecuencias, dentro de las que se incluye las voces de daño subjetivo, daño biológico, daño a la salud (o bienestar), daño a la libertad, daño objetivo, daño personal y daño extrapersonal.
dc.description.abstractThis thesis aim is to analyze the connection between the notions of “moral damage” and “damage to the person” with the purpose of evaluating their harmonious coexistence. For this, both doctrine and jurisprudence will be read through. Historically, the “moral damage” has its rooting in the Peruvian legal system given the correlation between the former and the French slope in which it is established a wide concept of “moral damage”, clear it is, there is also a strict sense (pain and suffering). On the other hand, the importation of the “damage to the person”, understood from the optic of existential philosophy and “legal personalism”, came from Italy, where the concept came to be in a postwar context where the place of the human being was reevaluated not only in Law, but in the world. Two are the categories to which the division of “damage to the person” refers: by the affected entity and by the consequences, which includes the voices of “subjective damage”, “biological damage”, “health damage” (or wellbeing), “damage to liberty”, “objective damage”, “personal damage” and “extra personal damage”.
