La inmatriculación de predios en el Perú: la seguridad jurídica que ofrece la inscripción registral

Resumen
La presente investigación se centra en el procedimiento de inscripción registral respecto a la inmatriculación de predios en nuestro país, no se agota en solamente explicar cómo funciona este procedimiento, sino en los beneficios que trae la inscripción registral al derecho de propiedad de los usuarios y no optar por permanecer en la informalidad plena, siendo la inmatriculación el acto a través del cual un predio se incorpora por primera vez al registro y empieza su historia registral. Se explican los aspectos fundamentales del registro como los principios registrales y los tipos de seguridad (dinámica y estática), es decir; en la relación segura y compenetrada que debe existir en el mercado entre personas que ostentan un capital, bien o derecho y las personas interesadas en adquirir esos beneficios en favor propio y del tráfico económico. Asimismo, del rol que desempeña el catastro y su relación con el Registro de Predios. Si bien, existen ciertos fundamentos de la jurisprudencia nacional que cuestionan la labor práctica del registro, no se debe perder el rumbo por prescindir de la labor registral sino, al contrario, se debe fortalecer e impulsar la misma, pues más predios inscritos es sinónimo de más predios formalizados y un país con más predios formalizados es un país que apunta al desarrollo como sociedad.
This investigation focuses on the registration procedure regarding the first registration of properties that exist in our country, this is not just limited to explaining how this procedure works but also on the benefits that registration brings to the property rights of the users so that they don’t choose to remain in a full informality. First registration being the act through which a property is incorporated into the registry for the first time and its registry history begins. Here are also explained the fundamental aspects of registry such as the registration principles and types of security (dynamic and static), that is the secure and integrated relationship that must exist in the market between people who hold capital, a property and rights and people who are interested in acquiring those benefits on their own behalf and for the course of trade. Also, about the task of cadastre, its problematic and intervention in the Registry. Although there are certain grounds of national jurisprudence that question the practical work of the registry, preferring unregistered methods in determining any legal battle regarding property rights, we shouldn’t lose our bearings by dispensing with the registry work, but on the contrary, it must be strengthened and promoted since more registered properties is synonym of more formalized properties and a country with more formalized properties is a country that aims for development as a society.
