Resumen
En el año 2009, el Sr. De la Cruz Paucar inició una relación laboral con la empresa contratista Cuprita J.P S.A.C ocupando el puesto de Perforista I. El demandante, en virtud del contrato de tercerización celebrado entre la empresa Sociedad Minera Austria Duvaz S.A.C (en adelante SMAD o empresa principal) y la contratista Cuprita J.P S.A.C, fue destacado realizando sus labores en la Unidad Minera de SMAD.
Con el paso de los años, el Sr. De la Cruz, junto a otros 100 trabajadores de la contratista Cuprita J.P S.A.C (en adelante CUPRITA o la contratista), consideraron que su vínculo se había desnaturalizado y; por tanto, sostenían ser trabajadores directos de la empresa SMAD, alegando que existían diversos elementos que acreditarían la relación directa con dicha empresa.
Bajo dicho contexto, el demandante y sus compañeros iniciaron una serie de demandas de desnaturalización de los contratos de tercerización, iniciando la controversia materia del presente análisis y discusión en las distintas instancias judiciales, incluso implicando que el debate se resuelva ante la Corte Suprema.
En estos casos se analizan diversos elementos controversiales que podrían implicar la desnaturalización de la tercerización laboral generadas en el sector minero, los cuales pasaremos a estudiar en el presente informe.
In 2009, Mr. De la Cruz Paucar started working with the contractor company Cuprita J.P S.A.C. under the position of Drill Operator I. It is by virtue of this outsourcing contract entered into between Sociedad Minera Austria Duvaz S.A.C. and Cuprita J.P S.A.C., that Mr. de la Cruz was assigned to work in the Mining Unit of Sociedad Minera Austria Duvaz S.A.C. Over the years, Mr. De la Cruz, together with 100 other workers of the contractor Cuprita J.P S.A.C. (hereinafter CUPRITA or contractor), considered that their relationship had been denaturalized and, therefore, they claimed to be direct workers of Sociedad Minera Austria Duvaz S.A.C. (hereinafter SMAD or main company), upon determining that there were several elements that would prove the direct relationship with said company. In this context, the plaintiff and his co-workers initiated a series of lawsuits for denaturalization of the outsourcing contracts, generating controversy and discussion in different judicial instances, even implying that the debate be resolved before the Supreme Court. In this case, it is possible to visualize several controversial elements that could imply the denaturalization of labor outsourcing generated under the framework of the mining sector.
